TERMS OF SERVICE

 

DEFINITIONS

1. - "Account", "Client", "Customer", "Consumer" or "User"– This is you. A client or enquirer into the services offered by Sally Gardner Yoga. A holder of a registered user account with Sally Gardner Yoga

2. - "Software" – website and apps of Sally Gardner Yoga 

3. - "Content" means any data, text, files, information, images, graphics, photos, links and other Content or materials created and owned by Sally Gardner Yoga 

4. – "Product" means any digital or physical product purchased directly or indirectly through the Sally Gardner Yoga website.

5. - "Seller" – means the company/brand you are purchasing from, in this case,  Sally Gardner Yoga 

6. -"Service" – means all bookable services such as consultations, 1:1 sessions, group classes, packages, online courses or programmes, and online sessions of all kinds, as well as the members' area of the Sally Gardner Yoga website

GENERAL TERMS OF USE:

1. You must create an Account to use the Service.

2. You must be at least 16 years old to use the Service.

3. You are responsible for any activity that occurs through your Account, and you agree you will not sell, transfer, license or assign your Account, followers, username, or any Account rights. With the exception of people or businesses that are expressly authorised to create Accounts on behalf of their employers or clients, we prohibit the creation of, and you agree that you will not create an account for anyone other than yourself.

4. You agree that all information you provide or provide to us upon registration and at all other times will be true, accurate, current and complete. You agree to update your information to maintain its truthfulness and accuracy.

5. You agree that you will not solicit, collect or use the login credentials of other Sally Gardner Yoga users or clients.

6. You are responsible for keeping your password secret and secure.

7. All users of Sally Gardner Yoga Services or Products are advised to get the approval of a doctor or suitable medical professional before practising the exercises and practises taught in the sessions, classes and courses. Sally Gardner Yoga is not responsible for any injury, pain, mental health issues or death incurred while practising or as a result of practising.

RIGHTS & OWNERSHIP

1. The Software contains Content owned or licensed by Sally Gardner Yoga. Sally Gardner Yoga Content is protected by copyright and other laws, and, as between you and Sally Gardner Yoga, Sally Gardner Yoga owns and retains all rights in the Content and the Software. You will not remove, alter or conceal any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Sally Gardner Yoga Content. You will not reproduce, modify, adapt, or prepare derivative works based on, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the Sally Gardner Yoga Content.

2. Sally Gardner Yoga name and logo are owned by the Seller and may not be copied, imitated or used, in whole or in part, without the prior written permission of Sally Gardner Yoga.

RETURNS TERMS

This Refund and Returns Policy applies for all Products and Services purchased through the Sally Gardner Yoga checkout.

You acknowledge that Sally Gardner Yoga provides a platform for users to purchase Products and Services from a Seller and that a sales contract is formed between you and Sally Gardner Yoga.

You will be sent confirmation of the sales contract between Sally Gardner Yoga and yourself via email promptly after the conclusion of the contract.

CANCELLATION OF SERVICE

You have 30 days from the date of purchase to cancel your Service unless the Service has already been provided / the appointment has taken place. It is not possible to request a refund for an appointment that has already taken place, even if this is within the 30-day period. If you have purchased a Package and do not wish to complete the programme, you can cancel this at any point during these 30 days by emailing hello@sallygardner.yoga. Please be aware that you will be charged 75 euros per session already taken, which will be deducted from your refund. It is not possible to cancel a package after the 30 days have lapsed, regardless of whether any sessions have been used. Individual online group classes can be rescheduled or cancelled up to 24 hours before the start time in your members' area. The 30-day cancellation policy does not apply to downloadable programmes, guides or online courses; please see 'Digital Products' below for further details on this type of Service.

DIGITAL PRODUCTS

You acknowledge that the Seller is not obliged to provide a refund on digital Products (which includes all downloadable programmes, guides and online courses) purchased on this website. Once access has been granted, or a download of a digital product has started, you do not have the right to cancel the purchase or request a refund.

Refunds for digital products shall only be given in the following limited circumstances:

1. If there was a technical issue and the Content was never received by the buyer.

2. If there was a duplicate order or payment due to a technical fault. Genuine multiple orders by the same person are not eligible for a refund.

3. If the transaction was not genuine (e.g. card fraud etc.)

We must be informed of circumstances 1 and 2 within 24 hours of the purchase and within seven days of circumstance 3. We may require additional details from you to notify the police of any fraudulent activity and advise that any card fraud claims also be reported to your bank.

ACCEPTABLE USE POLICY

This acceptable use policy sets out the terms between you and Sally Gardner Yoga under which you may access the Service. This acceptable use policy applies to all users of the Service and visitors to the website.

Your use of our site means that you accept and agree to abide by all the policies in this acceptable use policy, which form part of our Terms and Conditions.

PROHIBITED USES

You may use our site only for lawful purposes. You may not use our site:

• In any way that breaches any applicable local, national or international law or regulation.

• In any way that is unlawful or fraudulent or has any illegal or fraudulent purpose or effect.

• For the purpose of harming or attempting to harm minors in any way.

• To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.

• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

• To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to affect the operation of any computer software or hardware adversely.

You also agree:

• Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of our General Terms of Use provisions.

• Not to access without authority, interfere with, damage or disrupt:

     - any part of our site;

     - any equipment or network on which our site is stored;

     - any software used in the provision of our site; or

     - any equipment, network, or Software owned or used by any third party.

• Not to abuse Sally Gardner through messages, calls, emails and social media. Any form of abuse will result in your Account being blocked and reported.

We will provide clear information to you about the kind of Service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).

CHANGES TO POLICY

We may revise this policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by conditions or notices published elsewhere on our site.
